RELEASE, INDEMNITY & ASSUMPTION OF RISK AGREEMENT
BY SIGNING BELOW, YOU ARE RELEASING IMPORTANT RIGHTS
IIn consideration for permission to enter, use, or participate in any activity at Tetelestai Range, LLC, located at 44248 W. Frier, Tonopah, AZ 85354 (“Premises”), I, for myself, my heirs, executors, administrators, and assigns, agree as follows:
1. ASSUMPTION OF RISK
I understand and acknowledge the inherent and obvious dangers associated with firearms and shooting-range activities, including but not limited to: the discharge of firearms, accidental discharges, ricochets, flying debris, noise exposure, hot brass injuries, equipment malfunction, actions of other participants, and environmental hazards.
I freely and voluntarily assume all such risks, whether known or unknown.
2. RELEASE OF LIABILITY
I fully and forever release Tetelestai Range, LLC, including its owners, members, oƯicers, directors, employees, volunteers, insurers, agents, and representatives (collectively “Released Parties”), from any and all liability for personal injury, death, property damage, or other loss arising out of or related to my presence on the Premises or participation in any activity, including claims based on the negligent acts or omissions of the Released Parties. This release does not apply to gross negligence or willful misconduct, to the extent such limitations are prohibited by Arizona law.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, actions, damages, attorney’s fees, and costs arising out of or related to:
My conduct or actions
My use of firearms, ammunition, or equipment
My violation of range rules or directions of Range Safety OƯicers,
Any claim brought by a minor for whom I sign this agreement.
4. PARENT/GUARDIAN AGREEMENT (IF APPLICABLE)
If I am signing on behalf of a minor, I certify that I am the minor’s parent or legal guardian and that I have full authority to execute this agreement on their behalf.
To the fullest extent permitted by law, I waive, release, and indemnify the Released Parties from any claim brought by or on behalf of the minor arising from their participation or presence on the Premises.
5. CONSENT TO MONITORING, SAFETY ENFORCEMENT & REMOVAL
I understand the Premises may use video and audio surveillance for safety and security. I consent to such monitoring.
I agree to follow all posted rules and all instructions from Range Safety Officers. I understand that failure to comply may result in removal from the Premises without refund.
6. ALCOHOL, DRUGS & IMPAIRMENT POLICY
I understand that alcohol, drugs, cannabis, and any impairing substances are strictly prohibited on the Premises.Tetelestai Range, LLC staff and Range Safety Officers reserve the absolute discretion to deny access to the Premises, refuse participation, or require immediate removal of any individual who appears, in their reasonable judgment, to be under the influence of alcohol, drugs, or any substance that may impair judgment, coordination, or safety.
No refund will be issued in such circumstances.
7. ARBITRATION, VENUE & GOVERNING LAW
Any dispute arising out of or relating to this agreement or my activities at the Premises shall be resolved by binding arbitration under Arizona law. Venue for arbitration or any permitted court action shall be Maricopa County, Arizona.
This agreement is governed by the laws of the State of Arizona.
8. SEVERABILITY
If any provision of this agreement is found unenforceable, the remaining provisions shall remain in effect and enforceable to the maximum extent permitted by law.
9. ACKNOWLEDGMENT
I acknowledge that I have read this agreement carefully, understand its terms, and understand that I am giving up substantial legal rights, including the right to sue for ordinary negligence.
I sign this agreement knowingly and voluntarily.
Range Safety Rules
WARNING! Violation of these Rules or Tetelestai Range, LLC. Range Safety Officer's (RSO)Commands may result in revocation of your shooting privileges and/or ejection from the facility with no refund!
•Only Arizona legal weapons are allowed on the range. Shooters shall be responsible for knowledge of and their compliance with all state and federal laws.
• Eye and Ear protection are MANDATORY at all times.
• NO ALCOHOL or DRUGS are allowed on the range at any time.
• Minors shall be supervised by an adult at all times.
• Shooter shall know and understand SAFE operation of all firearms in use.
• Shooter shall keep all firearms pointed in a safe direction.
• Firearms shall be loaded/unloaded with the barrel pointed down range.
• Shooter's finger shall remain off the trigger until ready to shoot.
• Firearms shall remain unloaded until ready to shoot. Firearms may not be loaded until the range has been cleared for Live Fire.
• Shooter shall obey all posted signs and all range commands and orders of Tetelestai Range, LLC. RSO.
• On The RSO's "Cease Fire" or similar command or while others are downrange, Shooters shall step away from the firing line and shall NOT handle firearms until the range is cleared for Live Fire by the RSO.
• Shooters shall ensure that only correct ammunition is used in a firearm. No larger than 7 ½ shot is allowed on the shotgun course. No incendiary, armor piercing or tracer ammunition is allowed anywhere at the range.
• Shooter shall use ONLY authorized and approved targets and stands. No exploding or other such action targets are allowed anywhere at the range.
• Targets will ONLY be placed at the rear berm of the shooting lane.
• Shooter shall remain aware of the target and what is beyond.
• Absolutely NO reckless or "Blue-Sky'' discharge of firearms or any shots which may result in projectiles escaping the shooting area. DO NOT allow your rounds to stray away from the target. Shooting or attempting to shoot structures, equipment, or facilities that are not designated targets, or within designated firing lanes is PROHIBITED!
Best Practices
1. Treat every firearm as always loaded.
2. Don't let the muzzle of your firearm cover anything which you don't intend to shoot.
3. Keep your finger OFF the trigger until your sights are on the target.
4. Always be sure of your target and everything beyond it.
5. THINK first. .. Shoot SECOND!
